Your use of and access to the MilkwoodJam Websites - www.milkwoodjam.com or www.myspace.com/milkwoodjam or any other site with information relating to MilkwoodJam - (the "web site") and any transactions you may make are subject to the terms and conditions which are set out below. By using this Site, your conduct indicates that you agree to be bound by the Terms. If you do not agree with the Terms do not use this web site, and you should exit this Site.

1 This Site is intended to be a source of useful information relating to concerts, shows or other productions ("Events"). MilkwoodJam shall use our reasonable endeavors to ensure that the information contained on the Site is accurate and up to date. We may update the content and make improvements or changes in the information, services and other materials on this Site at any time without notice.
2 MilkwoodJam is a live music Venue, and as such we may host, promote or produce the “Events” or work in conjunction with bands/performers or outside promoters to arrange “Events” whose details appear on this Site and for which you might wish to buy a ticket. We do on occasion control or organize some Events, also we work in conjunction with bands or outside promoters and as such set prices. We do not at present charge a booking fee for tickets collected from MilkwoodJam – however, on some occasions a booking fee or handling fee may be necessary and will be clearly expressed on both this site and on purchase of the tickets. External approved ticket agents (Derricks Music and www.Ticketwales.co.uk) may only charge a booking or handling fee and these may be set by them, the promoter or organizer of the Event. We do not accept any other liability for any ticket purchases made via this Site save as set out in these Terms. There may be other terms and conditions applicable to any Event and you should check the ticket agents or the promoter’s website or any site advertising the Event before committing to buy a ticket. Most will have clear statements of any applicable policies, (such as age restrictions) on their websites. 
3 All intellectual property rights in the design of this Site and the contents, selection and arrangement of all of the material which is available on the Site belongs to MilkwoodJam. No material from this Site may be used, without our prior written permission. Contents of this web site may not be copied, reproduced, distributed, republished, displayed, posted, commercially exploited in any way or transmitted in any form or by any means without the prior express written permission of MilkwoodJam. You may not distribute, display or copy any of the contents of the pages contained in this web site to third parties including, but not limited to "caching" any material on this web site for access by third parties and "mirroring" any material on this web site. You may print or download to disk the contents of an individual page of this web site for the purpose of private and personal non-commercial use. You may also permit your computer to make an electronically stored, transient copy of the content in this web site for the purpose of viewing it while connected to the Internet only.

Buying Tickets and Returns
6 Once you have purchased tickets, they can only be exchanged, refunded or returned in the circumstances described below:
- If we fail to fulfill an order as a result of any negligence, or similar act or omission of our own or in breach of contract the customer will be entitled to a full refund including any booking fee charged.
- If the event is postponed or material changes are made to the Event, namely a change of the venue or the headline act, the original tickets that you have purchased will remain valid for the revised event (except for in the case of cancellation) unless otherwise advised. However if you are unable to attend the revised event only the face value of the tickets will be refunded, as these are circumstances beyond our control. If the tickets have not been posted out, the processing fee will also be refunded.
- If the event is cancelled, refunds of the face value will be available from us for a period of 60 days from the date of cancellation. 
- There will be no refund for lost, stolen or damaged tickets (save that duplicate tickets may be possible if for seats) or if the venue or Event organizer provides different seats to those specified on the ticket.
- For any refund of face value, you will be required to return the tickets, on receipt of which we will make the refund. Under certain circumstances, you may be required to register your details for a refund, which will follow at a later date. In accordance with The Data Protection Act, all information provided to us must match those details provided when the tickets were originally purchased (purchase reference number etc). Refunds will not be given where the original details are not matched successfully, or cannot be supplied. Where possible, the refund will be made using the same method of payment that was used to purchase the tickets. Tickets should be returned either: _* By secure post to MilkwoodJam, 50 Plymouth Street, Swansea, SA1 3QQ_* In person to MilkwoodJam, 50 Plymouth Street, Swansea, SA1 3QQ._- Refund requests will be accepted up until 1 week before the date of the revised event or 1 week after notification of the change (whichever is the later) unless otherwise advised. We are unable to refund tickets that are received after this time.
7 It is your responsibility to ensure that tickets returned are received by us. It is therefore advisable to return any tickets either by secure post or in person.
8 When events are cancelled, postponed or the venue or content is significantly changed, we will do our best to inform all purchasers using the contact details provided when the booking was made. However it is the responsibility of the purchaser to check whether the event is going ahead at the scheduled date, time and venue. We cannot guarantee that we will be able to make contact with you.
9 It is the responsibility of our customers to inform MilkwoodJam of any change of address, contact telephone number or email address both before and after receipt of your tickets.
10 Always check your tickets on receipt, as mistakes cannot always be rectified later.
11 Although MilkwoodJam will use their best endeavors to indicate any age or other restrictions that apply to events, it is the customer's responsibility to ensure that they are eligible for entry to the event that they are purchasing tickets for. 
12 It is policy that any person under the age of 16 must be accompanied by an adult to the venue (unless the event has specified otherwise).
13 We will not be liable to you for any loss of enjoyment or profit nor any indirect, consequential, exemplary, incidental, special or punitive damages.
14 We will not be liable for any misrepresentations, negligence, contractual or tortuous loss of any kind suffered by you from the products, or services, or actions of any performer, promoter or others.
15 Tickets ordered through this site, collected at the venue or from our designated agents are only for your personal use and that of your party. We reserve the right to cancel tickets purchased if there is any resale or attempted resale of tickets at a higher price than purchased, this includes tickets being resold to the public at an inflated price including via auction sites such as EBAY. The holder of a resold ticket may be refused entry or rejected from the venue.
16 If you are collecting your tickets from the venue, at present the venue can only accept cash. Designated ticket suppliers may take card payment and if so, please be advised that the tickets must be collected by the cardholder in person, and that the credit card must be presented on collection. The cardholders' signature will be required on collection.
17 Designated ticket agents may have no standard dispatch time for tickets ordered through their site as tickets for different events have different dispatch times. However, all tickets should be received at least one week before the event, unless they are being collected from the venue. Tickets booked within 10 days of an event that are being posted, may be received slightly later, but should be received at least 2 days before an event.
18 If it becomes impractical to post tickets out due to proximity of an event or circumstances beyond Designated ticket suppliers control, they may reserve the right to make the tickets available for collection at the venue and will inform you accordingly.
19 For certain events there may be a restriction on the maximum number of tickets that may be purchased. We will use our best endeavors to publish this information on the Site and at the point of ticket selection for the event. In such case, we reserve the right to only offer for sale the maximum number of tickets available and to cancel any orders made that exceed the maximum authorized tickets per customer without notice.
20 If tickets dispatched by special delivery are returned as ’addressee unknown’, we reserve the right to cancel the order.Privacy Policy and Data Protection
21 We know that you care how information about you is used and shared and we appreciate your trust in us to do that carefully and sensibly. This notice describes the privacy policy of MilkwoodJam LTD. By visiting Milkwoodjam.com, and by registering and using this Site you expressly consent and accept to the practices described in this Privacy Policy. 
- We will not send you unsolicited emails (spam). 
- We will not share your personal information for marketing without your consent.
- Any personal information which we get from you or gather about you from your use of our site will be used to contact you by post, phone, email or SMS when necessary in connection with transactions entered into by you on the site. Please note that by booking with MilkwoodJam you are consenting to your personal information being shared with an event organizer or promoter or venue for the particular event for which you are buying tickets. You should contact them if you would prefer not to receive information from them. Information will only be passed to event organizers for certain events where this is requested.
- If financial information that is collected from you is used to authorize payment and bill you. Your consent is given to provide your financial or personal information to those third parties necessary to process your transactions with us, such as credit card companies, banks and those companies that handle shipping and fraud protection.
22 You have a right to ask what information we, or a retailer holds about you. This can be done in writing to us at the contact address below.
23 Cookies_ A cookie is a small file that is automatically issued to your computer when you enter this Site and which is stored by the browser on your computer's hard drive. Cookies identify your computer, not the individual user of your computer.
You can disable cookies or set your browser to alert you when cookies are being sent. Cookies can be deleted from your hard drive if you wish.
24 If these Terms are not complied with, we reserve the right to terminate access and use of the site.
Events Outside Our Control
25 We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under a Contract that is caused by events outside our reasonable control (Force Majeure Event).
A Force Majeure Event includes any act, event, non-happening, omission or accident beyond our reasonable control and includes in particular (without limitation) the following:
- Strikes, lock-outs or other industrial action.
- Civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war.
- Fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster.
- Impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport.
- Impossibility of the use of public or private telecommunications networks.
- The acts, decrees, legislation, regulations or restrictions of any government.
Our performance under any Contract is deemed to be suspended for the period that the Force Majeure Event continues, and we will have an extension of time for performance for the duration of that period. We will use our reasonable endeavors to bring the Force Majeure Event to a close or to find a solution by which our obligations under the Contract may be performed despite the Force Majeure Event.
Noise Levels at MilkwoodJam Live Music Events
26 We're bound by the Control of Noise at Work Regulations 2005 and have policies in place to limit our employees' exposure to noise under this statutory regulation. And we take the safety of employees and customers seriously.
“The Control of Noise at Work Regulations 2005 don’t apply to audiences, whose exposure is deemed to be voluntary. That said, the Health and Safety Executive publish a guidance note (HSG195) that suggests an Event Equivalent Continuous Sound Level (Event Leq) limit of 107 dB(A) overall, with a peak limit of 140 dB. If the Event Leq’s over 96dB(A), they suggest notices are displayed at venue entrances and/or warnings printed on tickets.” 
We believe in the live music experience and also care about the long term well-being of all of our customers and staff and would therefore recommend that if prolonged exposure to high sound levels occur it may be wise to wear hearing protection. 
About Milkwoodjam
27 We reserve the right to refuse admission to an Event and tickets are issued subject to the rules and regulations of the venue. We will therefore not offer refunds to any ticket-holders who may be refused entry. 
RULES & REGULATIONS OF MILKWOODJAM

We follow the SWANSEA STANDARD CODE OF CONDUCT in Licensed premises
We work with Safer Swansea, BID Swansea, South Wales Police, Swansea Pub & Club Watch.
Under 21? If you are fortunate enough to look under 21, you will be asked for proof of age. We will only accept your passport or photocard driving licence.
If you are under 18 you are committing an offence if you attempt to buy alcohol & you are committing an offence if you are over 18 and supplying alcohol to a minor.
NO VIOLENCE Anyone threatening or using violence either in or outside the premises will be reported to the Police and banned. Our staff are aware of all banning orders issued under the SAFER SWANSEA PARTNERSHIP’S EXCLUSION ZONE SCHEME, whereby if you’re banned from one premises, you’re banned from them all.
BE NICE We expect all our staff to be treated with respect at all times. Verbal or physical abuse towards the staff will not be tolerated. Anyone behaving inappropriately will be escorted from the premises and banned. Premises are in contact with each other via a private radio network which is monitored by the police and CCTV.
NO DRUGS As a CONDITION OF ENTRY into these premises we may at our discretion utilize a stop and search procedure. Anyone found in possession of any controlled substances on the premises will be reported to the Police and banned.
DRINK RESPONSIBLY Know your limits. Please take care of yourself and others by drinking responsibly. If we feel you have had enough to drink, you will not be served. 
No glasses or bottles will be allowed outside of the premises. As so we have a policy to keep all drinks in the hall.
DISCRETION Entry into the premises is at our discretion. We reserve the right to refuse you entry.
- Each member of the audience must be in possession of a valid ticket.
- Tickets cannot be refunded or exchanged.
- Tickets must not be sold for profit or commercial gain by any outlet other than MilkwoodJam or one of its authorized agents.
- MilkwoodJam reserves the right to make alterations to the advertised programme at any time and without advance notice.
- Failure to comply with any of our rules & regulations will make this ticket and transaction void.
- As a ticket holder you consent to being photographed or filmed as a member of the audience, and its use in commercial distribution and publication and MilkwoodJam marketing and website, without payment or copyright.
- The unauthorized use of photographic and recording equipment at the venue is prohibited.
- We will not be liable to you for any loss of damage to any equipment or property left unattended or otherwise within the venue.
- No personal Food or drink is permitted to be brought in and consumed at the venue.
- Pets are not allowed into MilkwoodJam. Guide dogs however are permitted, but please be aware that some concerts can be loud and therefore may cause distress, but please contact us to discuss your requirements.
- All contracted Door Staff are SIA Registered
28 These Terms represent the entire understanding and agreement between you and us and shall have priority over any and all prior statements, understandings or agreements whether oral or in writing.
29 We may modify these Terms at any time, and such modifications shall be effective immediately upon posting of the modified Terms on this Site. Your continued access or use of this Site shall be deemed your acceptance of the modified Terms applicable from time to time.
30 These Terms are governed by the laws of England and Wales and any disputes subject to the exclusive jurisdiction of the Courts and, by using this Site, you hereby submit to the jurisdiction of such courts for such purposes and waive any and all objections to jurisdiction or venue in such courts. If any court finds any provision of these terms to be void or unenforceable for any reason, then such provision shall be ineffective to the extent of the courts finding without affecting the validity and enforceability of any remaining provisions.
